Brian McGinlay (born 24 August 1945) is a retired football referee from Scotland, who is considered to be the country's top referee of his era, and officiated in 98 European club competition and international matches.

At the domestic level McGinlay has refereed 21 Old Firm derbies, during which he never sent off a player, but he considers his most nerve-racking match to be the RangersAberdeen title decider match at the climax of the 1990-91 season. In European club football he judges his most exciting match to be the Real MadridBorussia Moenchengladbach third-round second-leg UEFA Cup match. In international football he has taken charge of matches at the 1980 European Championships, the Home Championship and the 1984 Summer Olympics. He was placed on the referees' list for the 1986 World Cup but was later removed after a late night incident in Glasgow. He was re-instated two years later, but suddenly retired for good in 1992.

In 1991 McGinlay was banned from driving for a year and fined £250 for failing to provide a sample when stopped on his way home from the Scottish Cup Final. He was dropped by UEFA in February 1992 after failing a physical exam.

Sexuality

In 1987 the Crown Office cleared McGinlay of charges relating to gay sex. In 1992 he was questioned by Police after an alleged incident in a central Glasgow toilet, but escaped charges. That year he also separated from his wife who moved out of the family home.

Retirement

Since retirement as a referee McGinlay has been a director of Stenhousemuir Football Club, an after-dinner speaker, and a columnist for the Daily Mirror, the Daily Record and the Sunday Mail. He was the subject of an investigation into an alleged £7,000 insurance fraud in 1995. While speaking at Iain Durrant's testimonial dinner in 1998, McGinlay is reported to have boasted that he never gave Celtic anything throughout the 21 Old Firm games in which he officiated.
