In the ], Di Biase faced Lorna Jackson's daughter ] and lost in one of the closest races of the night by 90 votes. Following the announcement of results, Di Biase requested a recount, however, shortly after, he announced his intention to apply to the ] to have the results of the election declared illegal and void . With 116 polls out of a total 130 counted Di Biase led by over 700 votes but Linda Jackson surged ahead by 90 votes after the remaining 14 polls were counted. Di Biase’s campaign manager Ralph Capocci, who is the President of the Federal Liberal Riding Association for Vaughan, said the result of the remaining 14 polls is “statistically improbable”. Although, the 14 polls all came from the Ward 5 area of Vaughan where Di Biase was mutually and publicly endorsing the incumbent Ward 5 councillor Alan Shefman In the ], Di Biase faced Lorna Jackson's daughter ] and lost in one of the closest races of the night by 90 votes. Although Shefman was re-elected he managed to receive only 38.4% of the vote (2944) therefore 61.6% (4729) voted against Di Biase/Shefman indicating the final count was very probable and most likely correct. Many Vaughan residents now believe the mutual endorsement of Shefman cost Di Biase the election.

Michael Di Biase is the outgoing mayor of Vaughan, Ontario, a suburb of Toronto, Ontario, Canada. He became involved in the city's political sphere when elected local councilor in 1986. Following the death of Mayor Lorna Jackson in 2002, Di Biase was appointed acting mayor by virtue of his position as senior regional councilor (a position he had held since 1988). In the 2003 municipal election, Di Biase won his first official term as mayor.

The Globe and Mail newspaper reports that Mayor Di Biase receives a salary of $164,074 per year, making him one of the highest-paid municipal politicians in the country. The next highest paid mayor is Hazel McCallion of Mississauga at $158,704. The mayor of the largest city in Canada, David Miller of Toronto, receives $143,635 per year. The average salary of Vaughan councilors is $102,657 which is second to that of Mississauga at $113,296, while Toronto councilors earn $85,497.
