  The article is of value to the project, as you concede, and the photo is of value to the article, as explained on the talk page. It's under a free license, about which there really isn't any question, and whether the uploader was later blocked or not has nothing to do with it. • Apparently, my friends had uploaded these images to Misplaced Pages along with another one that they intended to use in a less-than-flattering joke page about me back in 2005, which I believe was before I started editing. • Keep (with a proviso): The image is of clear relevance to the Matt Sanchez article - it illustrates the conduct of the debate relating to Matt at Columbia University. The juxtaposition of images creates a poster with meaning substantially in variance from that of the original copyright-restricted photographs. It allows the reader to consider the rhetoric in that debate in a way different from that provided by a textual summary, and thus is an appropriate illustrative image. The proviso on my suggestion relates to the legailty, which is an area I am unqualified to judge. John's fair use rationale seems reasonable to me, and the image is certainly not replaceable; however, I do not know whether this is sufficient for a valid fair use justification. That may be a problem, but it is completely irrelevant to whether we want to keep this image under fair-use.

The "Free" aspect of this image is to do with redistribution of this photograph; the "fair use" tag has to do with the reuse of the image, where some non-free elements within the prevent it from being completely free. The crux of the issue is whether the GFDL license requires that all elements are reusable without limitation - my understanding of the GFDL is that it does not have wording to that effect.

Perhaps we need to also tag this image as {{non-free historical}} to ensure that downstream users of the Sanchez article know that they need to review the image before including it in their own edition. John Vandenberg (talk) 04:26, 22 February 2008 (UTC)

• Delete. Although I like articles to have images the use of unfree images within this one renders it also unfree, IMHO. Also one standard, from what I've learned is that can text describing the image convey to the reader what one would expect to see. I think in this case it's a yes. The Sanchez article is just stinky with image issues so I'm inclined to have only images that are clearly free, devoid of drama, conflict and caveats. Eventually someone credible will take a photo of Sanchez and will give it freely to commons. Benjiboi 13:33, 22 February 2008 (UTC)
  • This is completely bogus - this is not a photo of Sanchez. This looks like Benjiboi was sent here to vote, and didnt even bother to look at the image. This image is not replaceable with any other image; perhaps Benjiboi should read and comprehend Jay*Jay's comment above. The article does not become unfree due to this image being on it. The article is free; and the redistribution specific about this image is slightly more complex due to the reuse of copyright material, however any downstream re-users of this image in the context of an encyclopedic will be able to claim fair use as well. Indeed, I came here as I was, and still am, looking for acceptable images, free of Sanchez's handiwork, that we can use on the article. Although being accused of meat-puppetry may sound sexy I can assure you I regularly get my fill of cleaning up after the mess Sanchez has made of the article so am hardly open to encouragement to dig even deeper into it all. It's sad he's violated the trust of other users but since his ban the article has indeed greatly improved and the talk page seems relatively civil and productive. Frankly the article needs less drama and this image can be replaced with description if needed. If it's kept then should be well documented who actually owns the image as well as the other images visible and that they have given wikipedia permission to use all the images concerned as appropriate. Jeez, benjiboi, you sound like such a fag. The article is looking more biased then ever. Who the hell wrote the part about Jeff Gannon and Marine porn star? It completely does not fit into the article. Benji and Eleemosynary are horrible editors. So far, they've just tried to turn the article into their little personal vendetta.

Where's the whole section about the racial slurring that is well sourced? Just pathetic people like the sodomite Benjiboy and his sidekick androgyn Eleemosynary.

Also, there is a link on the article talk page to this discussion but I happened to be looking for images for the article when I found this deletion discussion. Benjiboi

• The rule you're referring to: Significance. Non-free content is used only if its presence would significantly increase readers' understanding of the topic, and its omission would be detrimental to that understanding. Well, it does increase the reader's understanding of the topic, it is the officail picture for the official event, unless there is a rule that says event posters are not to be used in an event article. Also, source page does not suggest that image is in fact a logo, but just a way of formatting the text "Second Avenue Subway" in a specific font and colour, and so image does not add value to article.
