A note from User:RJaguar3
Hi, Tomballguy,
This is RJaguar3. Since it appears that we haven't been able to agree about whether some of your images should stay on Misplaced Pages, I thought I would explain my position more fully.
Copyright law, subject to certain exemptions, prohibits the copying, distribution, or publication of protected works. Works in the public domain or put under an appropriate free license can be redistributed and shared freely along with the rest of Misplaced Pages's content. Whenever possible, we must use free images and media to illustrate encyclopedia articles (WP:NFCC#1). However, sometimes, there are unfree images that would serve an encyclopedic purpose that are nevertheless not replaceable with free equivalents serving the same encyclopedic purpose. Under certain conditions (WP:NFCC), unfree images can be used in Misplaced Pages under the principle of fair use. The WP:BURDEN of proof is on the uploader to demonstrate why each point of WP:NFCC is satisfied using a fair-use rationale. Please see also WP:NFC#UUI for examples of unacceptable uses of unfree images on Misplaced Pages.
I disputed two of your images' fair use rationales. I will discuss my reasoning for each:
File:Game Over (Metroid).JPG
This image doesn't satisfy NFCC 1: as I pointed out, the image File:Torus Trooper - Game Over.jpg is a free equivalent that serves the same encyclopedic purpose: demonstrating what a game over screen looks like. Just because you say that it is not replaceable doesn't make it not replaceable. Further, your claim that the purpose of the image's use on Game over is "or general knowledge of what 'game over' means." This is akin to uploading an image of " rose, cropped from a record album, to illustrate an article on roses." (WP:NFC#UUI, 3). This image may well be a fair use in an article on Metroid Prime 3, if the game over screen was the subject of commentary in the article. The game over article doesn't discuss anywhere the specific screen in the image. I don't think that this problem can be remedied, but if you want to correct the issues to comply with NFCC (especially point 1), go ahead.
File:Ken Basin.JPG
First, I must commend you for amending the FUR to satisfy most of the issues I raised when I disputed it, instead of just removing the tag like in the Metroid Prime 3 screenshot. When I tagged your image with the dispute, I noted that there was "o thought given to FUR, including a purpose of 'For general purposes only' and 'Yes' as an answer to replaceability," and I pointed out that the given FUR " address WP:NFCC criteria 1 and 8." You corrected the replaceability answer to at least claim compliance with NFCC 1, and you claimed that the image "provides an illustration from a television game show to explain the contestant involved in an unfortunate event of the program, and is to be used solely for that purpose." I removed the image from Who Wants to Be a Millionaire (US game show) because (1) there was no rationale for use of the image in that article and (2) the image's use failed NFCC 8, as the prose paragraph accompanying the image sufficiently described the moment, and the image and its caption did not significantly enhance the article. I feel that the use on Who Wants to Be a Millionaire? is more justified, because it shows the use of the clock on the million dollar question, which is sufficiently elaborated on in the caption, significantly enhancing the encyclopedic value of the article because it enhances "critical commentary and discussion of the cinema and television" (see WP:NFCI), so I am leaving it as is on that article for the time being.
I would suggest reading through WP:NFCC to help us both understand what images we can use on Misplaced Pages and how we can use them, especially considering that you have uploaded a fair number of images.
Overall, I hope we can resolve this dispute in compliance with Misplaced Pages guidelines. I hate edit wars as much as or more than you do. I really don't want to get into one. But when you undo edits and remove speedy tags silently without addressing the issues raised, it doesn't contribute to the consensus-building necessary in a 💕. If the behavior of covering your ears and pretending that real issues with your edits don't exist continues, then I may have no choice but to invoke more Wikipedians in a formal dispute resolution process. Thanks, and happy editing. RJaguar3 | u | t 21:54, 15 September 2010 (UTC)
A kitten for you!
I like kittens and had absolutely had to give one to someone random in joy. Enjoy! :-)
