Revision as of 06:07, 29 September 2017

This non-free media file should be replaced with a smaller version to comply with Misplaced Pages's non-free content policy and United States copyright law. According to Misplaced Pages's policy for non-free content, the amount of copyrighted work used under fair use should be as little as possible. In particular, non-free media on Misplaced Pages should not be usable as substitutes for the original work. A high-resolution non-free image is questionable fair use and may be deleted per Misplaced Pages's copyright policy.

In most cases, this reduction will occur automatically: simply wait a while and a bot will resize the image file according to the guideline at WP:IMAGERES. When an automatic reduction does not occur or a manual reduction is desired, the size of an image may be reduced in an image editing program or by saving and re-uploading a suitably sized thumbnail.

Once a reduced version of this file has been uploaded: Please replace this template with {{subst:orphaned non-free revisions}} (through source edit) or {{orphaned non-free revisions|date=10 January 2025}} (through VisualEditor or Twinkle).Fair usetrue

Fair use rationale

This low resolution image is used in List of Picasso artworks 1961–1970, an article about and informative regarding the artist and his work, and is credited as a piece of artistic work. It is considered necessary for a proper understanding of the artist's creativity to be able to see this example of work. It is from a late period when his art took a new direction. This is specifically referred to in the article. It is considered that this will not cause commercial harm to the copyright holder. It is believed that this is fair use and does not infringe copyright. There is no known free alternative available.

According to section 107 of the United States Copyright Act of 1976 :

The fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

The image is used for non-profit purposes. This factor is noted as relevant by the Act.

CopyrightedThis image represents a two-dimensional work of art, such as a drawing, painting, print, or similar creation. The copyright for this image is likely owned by either the artist who created it, the individual who commissioned the work, or their legal heirs. It is believed that the use of low-resolution images of artworks:
  • for purposes of critical commentary on:
    • the specific work in question,
    • the artistic genre or technique employed in the artwork, or
    • the artistic school or tradition to which the artist is associated,
  • as applied within the English-language Misplaced Pages, hosted on servers located in the United States by the non-profit Wikimedia Foundation,

qualifies as fair use under United States copyright law.

Any other use of this image, whether on Misplaced Pages or elsewhere, could potentially constitute a copyright infringement. For further information, please refer to Misplaced Pages's guidelines on non-free content.
